O R D E R
This Writ Petition has been filed seeking for issuance of a Writ of Mandamus directing the first and second respondent to consider the representation made by the petitioner on 04.03.2019, wherein, the petitioner has sought for the correction of revenue records and for issuance of patta in his name with regard to the subject property in S.No. 935/1A.
2.The third respondent has filed a counter affidavit and has taken a stand that the name of the petitioner's grandmother was entered into in the revenue records before the UDR scheme. Subsequently, on verification, it was found that the land has been classified as Thimini kulam. In view of the same, the third respondent has taken a stand that no patta can be issued in favour of the petitioner. 3.In the considered view of this Court, unless and otherwise, correction is effected pursuant to the UDR, there is no scope for issue of 2/5
patta in favour of the petitioner with respect to the subject property. Hence, there shall be a direction to the second respondent to consider the representation made by the petitioner on 04.03.2019 on its own merits and in accordance with law and pass appropriate order within a period of twelve weeks from the date of receipt of a copy of this order. Pursuant to the order passed by the the second respondent, the petitioner can workout his remedy before the Tahsildar seeking for patta in his favour. The petitioner is directed to make a fresh representation along with all the relevant documents and a copy of this order.
4.This Writ Petition is disposed of with the above directions. No costs.
