ORDER

This Criminal Original Petition is filed to transfer the investigation in Crime No. 247 of 2024 on the file of the second respondent police to the 3rd respondent police or any other investigation agency under the supervision of first respondent.

The petitioner submitted that the petitioner herein is the de facto complainant who lodged the complaint before the second respondent police, stating that her husband Periyasamy went missing on 04.04.2024. Based on the complaint a case in Crime No.247 of 2024 was registered. A petition in HCP(MD)No.1501 of 2024 was filed by the petitioner before this Court and this Court dismissed the said petition recording the submission made by the learned Additional Public Prosecutor therein, on the instruction given by the second respondent, that the petitioner's husband had eloped with someother woman who is a Nurse. But the said 2/5

statement was not true and the said Nurse is living with her parents in the petitioner's locality. Since the second respondent has mislead the Court in the earlier HCP proceedings, seeking transfer of the investigation of the case, the present Criminal original Petition came to be filed.

3. Learned Government Advocate(Crl.side) submitted that the investigation in this case is still pending and it will be concluded within a short span of time.

4. In view of the submission made by the learned Government Advocate(Crl.side), this Court directs the second respondent police to expedite the investigation and complete the same within a period of four weeks. The first respondent is directed to monitor the ongoing investigation, by the second respondent police and the second respondent police is directed to appraise the progress in the investigation every Friday to the first respondent.

5. With the above direction, this Criminal Original Petition is disposed of.
