Prayer :- This petition filed under Section 482 of Criminal Procedure Code to restore the criminal original petition in Crl O.P (MD) No. 4322 of 2021 on the file of this Court to the file which was dismissed for non prosecution by setting aside the order dated 08.02.2024.

petition and the affidavit filed in support thereof and upon hearing the arguments of Mr. S.R.Anbarasu, Advocate for the Petitioner and of Mr. R.M.Anbunithi, Additional Public Prosecutor for the respondent No.1, this Court made the following order:

The above petition has been filed seeking orders to restore the appeal in Crl.OP(MD)No.4322 of 2021, which was dismissed for non-prosecution on 08.02.2024.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the State.

3. It is seen from the order of this Court dated 08.02.2024 that though the matter was listed for hearing on several occasions, the learned counsel for the petitioner was not ready for arguments. Hence, the petition was ordered to be dismissed for non-prosecution.

4. Being satisfied with the reasons stated in the affidavit filed in support of this petition, this petition is ordered and the Criminal Miscellaneous petition is allowed. 2/4

5. Post the matter on 17.04.2024.
