[Order of the Court was made by S.M.SUBRAMANIAM, J.] The summon issued by the State Human Rights Commission in Case No.1483/2016/HC3, dated 18.12.2024, is under challenge in this writ petition.
2. Learned counsel for the petitioner states that the petitioner is a public servant and retired from service. However, all these factual defence are to be stated before the State Human Rights Commission by the petitioner for passing appropriate orders. Contrarily, High Court, in exercise of the power of judicial review, cannot adjudicate the disputed facts, which are sub judice before the State Human Rights Commission constituted under the provisions of the Protection of Human Rights Act, 1993. Thus, the petitioner, is at liberty to respond to the impugned summon by approaching the State Human Rights Commission in the manner as contemplated under the Act and Rules in force.
3. Accordingly, this writ petition is dismissed. No costs. Consequently, connected miscellaneous petitions are closed. [S.M.S., J.] [A.D.M.C., J.] 16.06.2025 NCC :
