: Respondent PRAYER: Petition is filed under Article 226 of the Constitution of India praying for the issue of a Writ of Certiorari to call for the records in pursuant to the impugned order passed by the respondent vide his proceedings in Na.Ka.No.72/2020 dated 19.05.2020 and 06.06.2020 and quash the same as illegal.

ORDER

(Order of the Court was made by P.N.PRAKASH, J) Challenging the order dated 06.06.2020 passed by the respondent calling upon the petitioner to remove the encroachments in a pathway, the writ petition has been filed.

2. Heard the learned counsel for the petitioner and the learned Special Government Pleader for the respondent.

3. The learned counsel for the petitioner contended that the petitioner was not given an opportunity before the impugned order was issued.

4. In view of the above, we are of the opinion that the impugned order dated 06.06.2020 can be treated as a show cause notice and liberty is given to the petitioner to submit his representation to the respondent within two weeks from today and the respondent is directed to consider the same within two weeks, after the receipt of the representation and pass orders in accordance with https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD)No.6935 of 2020 law. No costs. Consequently connected Miscellaneous Petition is closed.
