This Criminal Original Petition is filed seeking a direction to the respondents not to interfere into the petitioner's construction work being carried on at T.S.No.1485/2, TPK Road, Ward No.32, Madurai and further direct the respondents not to harass, abuse and threaten the petitioner in connection with his construction work at the said property. 2.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) for the respondents.
3. The learned Government Advocate (Crl.Side), on instructions, would submit that in Crl.O.P.(MD)No.13963 of 2016, dated 08.08.2016, this Court directed the respondents to give police protection for removal of compound wall on condition that the petitioner should pay the amount for the damage, if any caused to the third respondent viz., S.A.S.Munsi.
Accordingly, the petitioner gave an undertaking and the first respondent gave https://hcservices.ecourts.gov.in/hcservices/
police protection.
4. The learned Government Advocate (Crl.Side) would further submit that while removing the compound wall, the petitioner has caused damage to the property of one Samsal Begum and on the basis of the complaint given by her, the respondent has issued summons to the petitioner. Suppressing the said fact, he has filed this petition.
5. This Court has gone through the order passed by this Court in Crl.O.P(MD)No.13963 of 2016, dated 08.08.2016 and the undertaking given by the petitioner to the respondent police.
6. In such view of the matter, this Court is not inclined to grant any relief as prayed for by the petitioner. Accordingly, this Criminal Original Petition is dismissed. Sd/- Assistant Registrar (CS-II) /True Copy/ Sub Assistant Registrar To:
