ORDER

This Contempt Petition has been filed to punish the contemnors/respondents for wilfully disobeying and not complying with the order of this Court passed in W.P(MD) No.18477 of 2022, dated 16.08.2022. 2.Heard Ms.G.A.Srijala, learned counsel for the petitioner, Mr.A.Raja, learned standing counsel for the first respondent and Mr.S.C.Herold Singh, learned Standing Counsel for the second respondent. 3.The Hon'ble Writ Court, vide judgment and order dated 16.08.2022, had disposed of the said writ petition with the following directions:- "7.In this background, there shall be a direction to the respondents to pay the interest to the petitioner at the rate of 6% per annum on the belated payment of the retirement benefits, commencing from the date of retirement, till the date of actual disbursement, within a period of three (3) months from the date of receipt of a copy of this order. "

4.The learned counsel for the petitioner submits that the order passed by this Court in W.P.(MD) No.18477 of 2022 dated 16.08.2022 has not been complied with. Thus, the respondents/contemnors have wilfully and deliberately flouted the order passed by this Court and are in contempt of the order of this Court dated 16.08.2022. Thus, they should be summoned and punished by exercising the powers under Sections 11 and 12 of the Contempt of Courts Act, 1971.

5.Today, when the matter is taken up, Mr.S.C.Herold Singh, learned Standing Counsel for the second respondent submits that the direction issued by this Court, vide order dated 16.08.2022, in W.P.(MD) No.18477 of 2022 has been complied with and the entire interest, as directed by the Hon'ble Writ Court, vide order dated 16.08.2022, at the rate of 6% per annum on the delayed payment of retirement benefits has already been paid to the petitioner and no amount is due to the petitioner. In this regard, he has produced a copy of the order of the first respondent, dated 16.07.2025 and a copy of the receipt issued by the second respondent, dated 12.01.2024, which are now taken on record and a copy of the same has also been given to the learned counsel for the petitioner. Thus, he submits that the respondents may be discharged from the present contempt proceedings, as the judgment and order of this Court in W.P.(MD) No.18477 of 2022, dated 16.08.2022 has 3/6

been fully complied with and the present Contempt Petition may also be disposed of.

6.Ms.G.A.Srijala, learned Counsel for the petitioner submits that she has received a copy of the order of the first respondent, dated 16.07.2025 and a copy of the receipt issued by the second respondent, dated 12.01.2024 and submits that she has no objection if the respondents are discharged from the contempt proceedings, as the judgment and order of this Court dated 16.08.2022 has been fully complied with by the respondents. She further submits that the entire interest amount, as directed by the Hon'ble Writ Court, vide order dated 16.08.2022, has already been credited in the account of the petitioner and no amount payable by the respondents is due to the petitioner. 7.Accordingly, in view of the submissions made by the learned counsels for the parties and after perusal of the order of the first respondent, dated 16.07.

8.Accordingly, the Contempt Petition is finally disposed of and the respondents are discharged from the present contempt proceedings. No costs. The file is consigned to record.
