ORDER : The Court made the following order :- The petitioner/A2, who apprehends arrest at the hands of the respondent police for the alleged offence under Sections 8(c) r/w 20 (b)(ii)(B) and 29(1) of the NDPS Act 1985 in Crime No.66 of 2021, seeks anticipatory bail.

2.The case of the prosecution is that on 14.02.2021 at about 13.00 hours, based on the secret information given by the informant, the respondent police conducted a vehicle check-up at Kumbum to Kombai near by-pass road, at that time, the petitioner along with others were in possession of 8kg of Ganja. Investigation revealed that the first accused and this petitioner had gone to Andhra and purchased Ganja for sale. Hence, the complaint. https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.5901 of 2021 3.The learned counsel for the petitioner submitted that the petitioner is innocent and he has not involved in this case and he has been falsely implicated in this case and based on the confession statement of the co-accused, this petitioner has been arrayed as A-2 and no recovery was made from him.

4.The learned Government Advocate (Criminal side) strongly opposed this petition on the ground that the petitioner is a habitual offender and having eight previous cases, which are similar in nature.

5.Taking note of the nature of the offence alleged to have committed by the petitioner and the fact that he is having eight previous cases, which are similar in nature, this Court is not inclined to grant anticipatory bail to the petitioner. 6.In the result, this petition is dismissed.
