This Petition is filed to condone the delay of 83 days in filing the above Civil Miscellaneous Appeal against the order passed in M.C.O.P.No.58 of 2021, dated 4.9.2024, on the file of the Motor Accidents Claims Tribunal/Subordinate Court, Aruppukkottai, Virudhunagar District. 2.Heard the learned counsel appearing for the Petitioner and perused the materials placed before this Court. The learned counsel for the Petitioner filed a memo stating that R5 was already set ex-parte before the Tribunal and no claim is sought for against R5 and prays to dispense with his appearance. Notice to R5 is dispensed with.

3.For the reasons stated in the accompanying affidavit filed in support of the Petition and on being satisfied with the same, this Petition is allowed and the delay is condoned.
