Respondent/ Petitioner PRAYER : Petition is filed under Section 24 of Civil Procedure Code, to withdraw H.M.O.P.No.77 of 2018 on the file of the Family Court, Madurai, and transfer the same to the file of the learned Principal Subordinate Judge, Dindigul, for disposal along with H.M.O.P.No.24 of 2018 pending on the file of the learned Principal Subordinate Judge, Dindigul.

O R D E R

The petitioner got married to the respondent on 23.08.2012. The respondent filed H.M.O.P.No.77 of 2018 before the Family Court, Madurai, seeking divorce.

The petitioner filed H.M.O.P.No.24 of 2018 before the Principal Subordinate Court, Dindigul, for restitution of conjugal rights. In the very nature of things, both the cases will have to be tried together.

2. This Court is of the view that in the interest of justice, the case filed by the husband should be transferred and tried along with the case filed by the wife. H.M.O.P.No.77 of 2018 is withdrawn from the file of the Family Court, Madurai, and transferred to the file of the Principal Subordinate Court, Dindigul, for joint trial along with H.M.O.P.No.24 of 2018. https://hcservices.ecourts.gov.in/hcservices/

3. The Transfer Civil Miscellaneous petition stands allowed, accordingly. No costs.
