Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the second respondent herein to dispose of the petitioner's representation which was taken on file in Na.Ka.No.5208/2021 on the basis of the petitioner's representation dated 21.07.2021 within the time stipulated by this Court.

*********** This Writ Petition has been filed for a Mandamus seeking for a direction to the second respondent to dispose of the petitioner's representation dated 21.07.2021, which was taken on file as Na.Ka.No.5208/2021, seeking for cancellation of UDR patta standing in the names of Duraisamy and Ponnusamy for the property comprised in S.No.2294/1 situated at Thadikombu Taluk, Dindigul District of an extent of 1⁄2 share in the property of an extent of 2 acres and 18 cents and pass final orders within a time frame to be fixed by this Court.
2.The petitioner claims that he is the absolute owner of the aforementioned property. He has filed the copy of the partition deed dated 13.07.2009 registered as Document No.4278 of 2009, under which he claims ownership. W.P.[MD]No.7012 of 2022 been issued for his property in favour of Duraisamy and Ponnusamy. In such circumstances, the petitioner has given a representation on 21.07.2021 to the second respondent seeking for cancellation of the patta issued in the names of Duraisamy and Ponnusamy. According to the petitioner, the second respondent has also taken the representation on file in Na.Ka.No.5208/2021. 3.No prejudice would be caused to the respondents if the petitioner's representation is considered on merits and in accordance with law after affording a fair hearing to the petitioner and the parties in whose names the patta stands, within a time frame to be fixed by this Court.
4.For the foregoing reasons, this Court directs the second respondent to pass final orders on the petitioner's representation dated 21.07.2021 seeking for cancellation of the UDR patta standing in the names of Duraisamy and Ponnusamy, in respect of the property comprised in S.No.2294/1, after UDR Sub-Division S.No.2294/1C situated at Thadikombu Taluk, Dindigul District, after affording a fair hearing to the petitioner, Duraisamy and Ponnusamy, including granting them the right of personal hearing within a period of three [3] months from the date of receipt of a copy of this order. 5.With the aforesaid direction, this Writ Petition stands disposed of. There shall be no order as to costs.
