4.Subbiah 5.S.Raja 6.K.S.Aandi : Respondents Prayer : Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure to direct the 2nd and 3rd respondent police and their men from not to interfere in civil dispute in regard to the petitioner's property in S.No.79/6 of Ramakrishnapuram Village and consequently direct the respondent police not to harass the petitioner and his family members on the guise of enquiry.

ORDER

This petition has been filed to direct the 2nd and 3rd respondent police and their men from not to interfere in civil dispute in regard to the petitioner's property in S.No.79/6 of Ramakrishnapuram Village and consequently direct the respondent police not to harass the petitioner and his family members on the guise of enquiry.

2. On the complaint given by one K.S.Aandi against this petitioner, a petition enquiry is pending in C.S.R.No.161 of 2017 before the respondent police.

3. Under such circumstances, the petitioner is directed to appear before the second respondent police and participate in the enquiry and during enquiry, he shall not be harassed. During the course of enquiry, if any cognizable offence is made out, the respondent police is free to register an FIR and this order shall not be a shield for the petitioner against arrest.

4. With the above direction, this Criminal Original Petition is disposed of.
