Prayer:

To suspend the sentence imposed by the learned Mahila Judge (Fast Track Mahila Court), Ramanathapuram District in S.C.No.174 of 20217 dated 24.09.2025 pending disposal of the Criminal Appeal.

ORDER

(Order of the Court was made by the Hon'ble N.Anand Venkatesh J.) This the second petition filed by the petitioner seeking suspension of sentence imposed on him by the learned Mahila Judge, Fast Track Mahila Court, Ramanathapuram District in S.C.No.174 of 20217 dated 24.09.2025 and to enlarge the petitioner on bail.

2. Earlier, the petitioner had filed a petition for suspension of sentence in Crl.M.P.(MD).No.2381 of 2025 and the same was dismissed as withdrawn by an order dated 04.02.2026. While going through the order, it is seen that the earlier Division Bench was not convinced on the merits of the case and the petition was about to be dismissed, at that stage, permission was sought for by the learned counsel appearing for the petitioner to withdraw the petition and accordingly, the said petition was dismissed as withdrawn.

3. In view of the above, we do not see any change in circumstances and the only change is the change in the constitution of the Bench and nothing more. Hence, we are not inclined to entertain this petition. Accordingly, this petition stands dismissed.

4. This Court has already called for the original records from the concerned Court. Hence, Registry is directed to prepare the paper book and include this appeal in the advance list to enable us to hear the appeal finally on merits.
