PRAYER IN CRL A(MD)No.45 of 2021:
Criminal Appeal filed may be pleased to set aside the conviction and sentence passed by the learned Additional District and Sessions Judge, Theni in S.C.No.95 of 2016 dated 14.02.2020 and acquit the Appellant.
Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.WILLIAM CHRISTOPHER.J., Advocate for the petitioner and of Mr.S.CHANDRASEKAR, Additional Public Prosecutor on behalf of the Respondent, the Court made the following order:- [Order of the Court was delivered by K.KALYANASUNDARAM, J.] This petition has been filed to modify the conditions imposed on the petitioner by this Court, vide order dated 18.02.2021 in Crl.M.P.(MD)No.664 of 2021 in Crl.A.(MD)No.45 of 2021. 2.The petitioner is A1 in S.C.No.95 of 2016 on the file of the 1/3
Additional District & Sessions Judge, Theni. While granting suspension of sentence to this petitioner, this Court on 18.02.2021 directing him to stay at Trichy and report before the learned Judicial Magistrate No.II, Trichy, at 10.30 a.m., on all working days, until further orders.
3. It is the submission of the learned counsel for the petitioner Mr.J.William Christopher, that the petitioner has been complying with the condition from 05.03.2021. It is also submitted that the petitioner's mother is suffering from breast cancer and therefore, the help of the petitioner is very much required.
4. Mr.K.K.Ramakrishnan, learned Additional Public Prosecutor appearing for the respondent submitted that the petitioner has been complying with the condition regularly since 05.03.2021. It is further submitted that in respect of A2 and A3, condition was relaxed by this Court on 19.04.2021 and they have been directed to appear before the committal Court on the first working day of every month at 10.30 a.m., until further orders.
5. In the light of the above facts and circumstances, the condition imposed on the petitioner in Crl.M.P.(MD)No.664 of 2021 in Crl.A.(MD)No.45 of 2021, dated 18.02.2021 is modified to the effect that the petitioner is directed to appear before the committal Court on the first working day of every month at 10.30 a.m., till the disposal of the appeal.
6. Accordingly, this petition is ordered.
