O R D E R

This Writ Petition has been filed for a Mandamus, seeking for a direction to the respondents to consider the petitioner's representation dated 18.12.2021 and pass final orders on merits and in accordance with law within a time frame to be fixed by this Court. 2.Counter affidavits have also been filed by the respondents in this Writ Petition, disputing the contentions of the petitioner as raised in this Writ Petition.

3.The following facts are not disputed:

a) The petitioner has not challenged the first selection list dated 14.05.2019, in which the petitioner was not selected. 2/6

b) Pursuant to G.O.(Ms).No.258, Law (LS) Department dated 17.08.2021, the petitioner was selected in the second selection list along with 10 other candidates.

c) The petitioner has accepted G.O.(Ms).No.258, dated 17.08.2021 and has joined employment as per the said G.O. 4.The petitioner's grievance is that candidates namely Mr.S.Karthick and Mrs.A.Sindhuja, who had secured 126.3 marks and 135 marks respectively, were included in the first selection list. According to the petitioner, one Sindhuja, who had secured 135 marks ought to have been included in the MBC / DNC / General category and one Karthick who had secured 126.3 marks ought to have been excluded from the first selection list. If he was excluded, the petitioner claims that she could have been included in the first selection list.

Admittedly, the petitioner has not challenged the first selection list, instead had filed a Writ Ptition seeking a Mandamus, to consider the petitioner's representation for inclusion of the petitioner in the first selection list. The petitioner also claims that his representation was not considered by the respondents despite a direction having been given by this Court through this Court's order dated 23.02.2021 in W.P.No.3962 of 2021. However, it is to be noted that pursuant to G.O.(Ms).No.258, Law (LS) Department dated 17.08.

employment and has also agreed to the terms and conditions of the appointment order. Having not challenged the first selection list in which the petitioner has been excluded from the selection list and that too, when the petitioner having accepted G.O.(Ms).No.258, Law (LS) Department dated 17.08.2021, by joining employment as per the said G.O., the question of re-agitating the issue with regard to the non-inclusion of the petitioner in the first selection list does not arise. 5.For the foregoing reasons, this Court does not find any merit in the Writ Petition.

6.Accordingly, this Writ Petition stands dismissed. There shall be no order as to costs.
