ORDER

This Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus, to quash the impugned refusal order of the 2nd 1/4

respondent in RFL/Joint Sub Registrar No.2 Virudhunagar/21/2023 dated 09.11.2023 and further directing the 2nd respondent to register the settlement deed dated 02.11.2023 executed by the petitioner in favour of her son by name T.M.Premkumar within a time framed as may be fixed by this Court.

2. It is seen from the records that the official respondent have rejected to register the sale deed since the land belongs to the temple. This issue was already considered by this Court in the case of Sudha Ravi Kumar and Another Vs. The Special Commissioner and Others in W.P.Nos.30589 of 2013 and batch, dated 05.04.2017, wherein it is directed to issue notice to the petitioner and the temple and conduct enquiry and pass orders.

3. Accordingly, this writ petition is allowed. The official respondents are directed to conduct an enquiry and pass orders in accordance to law, after issuing notice to both the parties, within a period of four weeks from the date of receipt of a copy of the order. No Costs.
