Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.ARAVINTHAN G, Advocate for the petitioner and of M/S.B.Thanga Aravindh, Government Advocate (Crl.Side) on behalf of the Respondent, the court made the following order:- This Criminal Miscellaneous Petition has been filed to modify the satisfaction of the Court as learned Judicial Magistrate, Valliyur, Tirunelveli District instead of Judicial Magistrate No.I, Kuzhithurai, Kanyakumari District in Crl.O.P.(MD)No.4291 of 2023, dated 06.03.2023.

2.The learned counsel for the petitioner would submit that since the de-facto complainant is a practising Advocate in the same Court, no one has appeared on behalf of the petitioner and he could not able to appear before the concerned Court and execute the sureties as directed by this Court. Hence, he would seek for modification.

CRL MP(MD) No.5084 of 2023 3.Considering the facts and circumstances of the case, the condition already imposed on the petitioner is modified to the effect that the petitioner shall execute sureties before the learned Judicial Magistrate, Valliyur, Tirunelveli District. 4.The time for surrender and execution of sureties is extended till 12.04.2023.
