PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the third respondent take action against the private respondents 4 to 5 for the misusing the petitioner's vehicle bearing registration No. TN 37 DP 7237 registered at second respondent office and recover the petitioner's vehicle from the illegal custody of the fourth respondent herein by considering the petitioner's representation dated 28.02.2025. O R D E R

This Writ Petition has been filed seeking a direction to the third respondent to take action against the private respondents 4 to 5 for the misusing the petitioner's vehicle bearing registration No. TN 37 DP 7237 registered at second respondent office and recover the vehicle from the illegal custody of the fourth respondent by considering the petitioner's 2/6

representation dated 28.02.2025.

2.According to the petitioner, she is the owner of the property and the fifth respondent is the son-in-law of the petitioner and he forcibly took the vehicle and handed over the same to the fourth respondent and now, the fourth respondent using the own board vehicle for commercial purpose, thereby, the petitioner sent the representation, dated 28.02.2025 to the respondents 1 to 3, but the same has not been considered. Hence this petition.

3.The learned Additional Public Prosecutor appearing for the respondent police would submit that the petitioner's representation is under consideration and the same will be considered and disposed of within a period of two weeks.

4.The learned Government Advocate appearing for the respondents 1 and 2 would submit that based on the petitioner's representation, they issued summons to both the parties and a date has been fixed for enquiry, I.e., on 20.03.2025 and the enquiry will be completed within a period of two weeks.

5.Since the prayer of the petitioner is to direct the respondents 1 to 3 to take action against the respondents 4 and 5 and to consider the representation pending before the respondents 1 to 3, this Court directs the respondents 1 to 3 to consider the representation of the petitioner and dispose of the same, within a period of fifteen days, after affording opportunity to both parties, in accordance with law. 6.With the above direction, this writ petition is disposed of. 19.03.2025 Internet :Yes Index :Yes/No NCC :Yes/No LR 4/6
