Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, forbearing the respondents from putting up any construction in S.No.300/1 of Vadaseripatti Village, Vellanur Panchayat, Kulathur Taluk, Pudukkottai District, which has been classified as "Meichal Tharai Puramboke"(Grazing Puramboke) by considering the petitioner's representation dated 13.12.2021 given to the third respondent. ORDER
The writ petitioner seeks to forbear the respondents from put up any construction over S.No.300/1 of Vadaseripatti Village, Vellanur Panchayat, Kulathur Taluk, Pudukkottai District. 2.The grievance of the petitioner is that the property is a "Meichal Tharai Puramboke"(Grazing Puramboke). The Slum Clearance Board had attempted to put up a construction over the said site. The petitioner pleads it affects the rights of agriculturists, who tend their cattle, over the said area. According to him, the only available lands for grazing the cattle have been taken up by the first and the second respondents. This Court entertained the writ petition and ordered notice to the respondents. 2/4
3.Mrs.Latha, learned Standing Counsel for the second respondent brought to the notice of this Court that construction has been completed by the Slum Clearance Board. She states prior to the completion of construction, the District Collector had granted enter upon permission on 16.02.2021 in Na.Ka.E5/10018/2020. The learned counsel brings my notice that the Government of Tamil Nadu through its Animal Husbandry Dairying and Fisheries (AH2) Department had issued G.O.(Ms).No.29, dated 08.02.2021. In terms of the order, the subject "Meichal Tharai Puramboke" was reclassified and alternative sites were granted for enabling the grazing of cattle. 4.As the entire construction is over and since the Animal Husbandry Department gave no objection, as is clear from the order, mandamus cannot be issued.
