ORDER

(Order of the Court was made by N. ANAND VENKATESH,J.) This Habeas Corpus Petition has been filed by the husband of the detenue seeking to produce the person or body of the detenue, aged about 35 years and to set her at liberty.

2. We have heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing on behalf of the respondents.

3. The petitioner was married to the detenue in the year 2012 and they have two children. All of a sudden, the wife of the petitioner went missing since 01.08.2025. In spite of the best efforts taken, the petitioner has not been able to ascertain the whereabouts of the detenue. Hence, a complaint was given before the second respondent Police, based on which, a woman missing FIR was registered in Crime No.469 of 2025. Since there was no progress in the investigation, the present petition has been filed before this Court.

4. The learned Additional Public Prosecutor, on instructions, submitted that the whereabouts of the wife of the petitioner are yet to be ascertained by the second respondent.

5. Taking into consideration the facts and circumstances of this case and the materials placed before this Court, there shall be a direction to the second respondent to ascertain the whereabouts of the detenue and produce her before the learned Judicial Magistrate No.V, Madurai. As and when the detenue is produced before the learned Judicial Magistrate, the petitioner shall be put on notice. The learned Judicial Magistrate No.V, Madurai, shall record the statement of the detenue and proceed further in accordance with law and submit a report before this Court.

6. This Habeas Corpus Petition is disposed of with the above directions.
