Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as sole accused, apprehending arrest at the hands of the respondent police for the offences punishable under Sections 376 and 511 IPC in Crime No.13 of 2018, on the file of the respondent police, seeks anticipatory bail. 2.This Court went through the contents of the FIR, in which, it is stated that the the petitioner is the second husband of the mother of the defacto complainant. It is further mentioned that the defacto complainant developed affair with one Sakthiful. In this background, the present allegation that the petitioner attempted to rape her has been made.

3.The learned counsel for the petitioner submits that the petitioner even though is only a step father to the defacto complainant, the petitioner cared for the defaacto complainant and warned the defacto complainant after knowing about her illicit intimacy.

4.Heard the learned Government Advocate (Crl.side) appearing for the State.

https://hcservices.ecourts.gov.in/hcservices/ 5.Taking note of the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner with

certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Additional Fast Track Mahila Court (Magistrate Level), Nagercoil, and on his executing a bond fora sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 10.30 a.m. for a period of one week and thereafter as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.

5.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy is made ready, failing which, the petition for anticipatory bail shall stand dismissed.
