Prayer in CRL MP(MD). No.3377 of 2021 :- Criminal Miscellaneous Petition is filed under section 482 of Criminal Procedure Code, praying this Hon'ble Court to Modify the condition imposed by this Honourable Court dated 09.03.2021 in Crl.R.C.(MD) No. 218/2020 in condition (b) against the Petitioner regarding to deposit a sum of Rs. 50,000/- (Rupees fifty thousand only) to the credit of Crime No.3 of 2020 before the Judicial Magistrate, Uthamapalayam, within a period of four weeks from the date of receipt of a copy of this order along with a bond for a sum of Rs.2,00,000/-(Rupees Two Lakhs Only) with two surities. Prayer in CRL RC(MD).No.218 of 2020 :

Criminal Revision Case filed under section 397 and 401 of Criminal Procedure Code, praying this Hon'ble Court to call for the records dated 12.02.2020 made in Crl.M.P.No.592 of 2020 on the file of the Judicial Magistrate, Uthamapalayam and consequently, direct the respondent police to hand over the vehicle (Mahendra Logan Dix car - TN 76 J 7943 to the petitioner within the time stipulated by this Court.

ORDER:- Criminal Revision Case coming upon for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.U.Dhanasekara Pandian, Advocate for the Petitioner and of Mr.R.M.S.Sethuraman, Counsel For State on behalf of the respondent, this Court made the following order:

This petition has been filed to modify the condition imposed by this Court, dated 09.03.2021 in Crl.R.C(MD)No.218 of 2020 in condition (b) against the petitioner regarding to deposit a sum of Rs.50,000/-(Rupees Fifty Thousand only) to the credit of Cr.No.3 of 2020 before the learned Judicial Magistrate, Uthamapalayam, within a https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL MP(MD). No.3377 of 2021 period of four weeks from the date of receipt of a copy of this order along with a bond for a sum of Rs.2,00,000/- (Rupees Two lakhs only) with two sureties for a like sum.

2.The learned counsel for the petitioner submitted that the petitioner purchased the vehicle as second hand in the year 2011 and he is the only breadwinner of his family. Hence, he prays this Court to modify the amount as Rs.25,000/-.

3.It is seen from the records that the type of Car is Mahendra Logan DLX Car). Therefore, the condition imposed on the petitioner to deposit a sum of Rs.50,000/- (Rupees fifty thousand only) is correct and it does not warrant any interference and the criminal miscellaneous petition stands dismissed.
