Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the second respondent to disburse the Subsistence Allowance to the petitioner from the period 03.03.2016 to till date as per Tamilnadu Payment of Subsistence Act, within the time limit that may be stipulated by this Court.

ORDER

Mr.N.Shanmuga Selvam, learned Additional Government Pleader takes notice for respondents.

2. By consent, the writ petition itself is taken up for final hearing.

3. The petitioner has come up with the present writ petition, to direct the the second respondent to disburse the Subsistence Allowance to the petitioner from the period 03.03.2016 to till date as per Tamilnadu Payment of Subsistence Act.

4.When the matter came up for hearing, on 30.05.2018, this Court directed the learned Additional Government Pleader to get instructions, as the petitioner had stated that though he was suspended on 03.03.2016, as per Rule 13(ii)(b) of the Tamil Nadu Payment of Subsistence Allowance Act, 1981, the petitioner is entitled for Subsistence Allowance, but the respondents have not https://hcservices.ecourts.gov.in/hcservices/

paid the same till date and hence, he seeks direction to the second respondent to disburse the Subsistence Allowance from 03.03.2016 till date, as per the Tamil Nadu Payment of Subsistence Allowance Act, 1981.

5.Today, the learned Additional Government Pleader on instruction, would submit that the respondents will disburse the Subsistence Allowance to the petitioner, as early as possible. 6.Recording the submission made by the learned Additional Government Pleader, the Writ Petition is disposed of, directing the second respondent to disburse the Subsistence Allowance, by paying all the arrears, to the petitioner, as per Rule 13(ii) (b) of the Tamil Nadu Payment of Subsistence Allowance Act, 1981, within a period of two weeks from the dated of receipt of a copy of this order. No costs.
