For Respondent : Mr.V.Neelakandan, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 288 of 2020 on the file of the Respondent Police ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.
2. The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under sections 147, 148, 341, 294(b), 324, 307 and 506(ii) of I.P.C., in Crime No.288 of 2020 on the file of the respondent police, seeks anticipatory bail.
3. The learned counsel for the petitioner submitted that the petitioner is arrayed as A7. He further submitted that the injured has been discharged from the hospital and the other accused are released on bail and anticipatory bail.
4.Per contra, the learned Additional Public Prosecutor resisted the same and submitted that since the victims have noticed the accused that the accused are creating problems by evicting the women. It was asked by the victims on 21.05.2020. Hence, on the same day at about 08.30 p.m., the accused attacked the victims with knife and caused injury to the victims. CRL OP(MD). No.6526 of 2020 injury on the right hand and hip portion. Therefore, the injured was initially admitted in Nilakottai Government Hospital and for higher treatment the injured was sent to Vellammal Medical College and Hospital, Madurai. The injured was treated as inpatient from 22.05.2020 to 12.06.2020. In view of the Covid pandemic, the injured was discharged from the hospital and advised to stay at Madurai for further treatment and he attended the hospital daily. Hence, he seeks dismissal of this anticipatory bail petition.
5. On a perusal of the order passed by the Sessions Judge, it is seen that some of the accused were granted bail and some of the accused were granted anticipatory bail.
6. Taking note of the specific overtact, the period of treatment and the weapon used, I am not inclined to grant relief to the petitioner.
