Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Certiorarified Mandamus to call for the records connected with the impugned order dated 20.05.2018 on the file of the second respondent and quash the same as illegal, consequently to direct the respondents to grant permission for conducting agitation on 02.06.2018, or any other earliest date, at Chinnappa Park by considering the petitioner's representation dated 26.05.2018 within the time stipulated by this Court.

O R D E R

The writ petition has been filed for issuance of a Writ of Certiorarified Mandamus to call for the records relating to the impugned order, dated 20.05.2018 on the file of the second respondent and quash the same as illegal and consequently direct the respondents to grant permission for conducting agitation on 02.06.2018 or any other earliest date at Chinnappa Park, by considering the petitioner's representation, dated 26.05.2018

2. According to the learned Government Advocate, the petitioner has filed the present writ petition before this Court challenging the rejection order passed by the respondent dated 20.05.2018. The learned Government Advocate would submit that the relief sought for by the petitioner has now become infructuous and further the place where he sought for agitation is a commercial place and hence, the same shall not be considered. Therefore, the impugned order has been passed.

3. At this stage, the learned counsel appearing for the petitioner would submit that the petitioner would make a fresh representation to the Deputy Superintendent of Police for the alternative place to seek permission to conduct the demonstration.

4. Considering the submissions made by both sides, this Court directs that if any such representation is received from the petitioner, the Deputy Superintendent of Police shall consider the said representation and pass appropriate orders on merits and in accordance with law. It is made clear that this Court will not express any opinion on the merits of the case.

5. This writ petition is disposed of with the above direction. No costs.
