ORDER

(Order of the Court was made by S.M.SUBRAMANIAM, J.) The Writ Petition has been instituted challenging G.O.(Ms).No. 193, Public Works (N1) Department dated 12.11.2019. 2.The Government passed an order for the diversion of flood surplus water from the Mettur reservoir to the dry tanks in Saragabanga Sub-Basin in Salem District by lift irrigation, at an estimated cost of Rs.565 crores. Sanction was accorded by the Government for implementing the project.

3.It is a welfare project sanctioned to regulate the surplus water in Mettur Dam, which would be of greater assistance to the farmers and ayacutdhars in that locality. Moreover, it is a policy decision taken by the Government and would fall beyond the realm of the powers of the judicial review conferred on the High Court under Article 226 of the Constitution of India.

4.Accordingly, this Writ Petition is not entertainable and the same is dismissed. There shall be no order as to costs. Consequently, connected Miscellaneous Petitions are closed.
