Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Mandamus directing the respondents to consider the petitioner remove the block or de-freeze of the petitioner Trust Current Account bearing A/C.No. 772644561 maintained with the 1st respondent Bank forthwith and consequently, direct the 1/6

respondents to permit the petitioner to operate the account without any obstruction based on petitioner representation dated 16.01.2026. For Petitioner : Mr.S.Madhavan For Respondents : Mr.C.Karthik

ORDER

The petitioner is before this Court seeking for a direction to the respondent to defreeze the petitioner's Trust current account bearing No. 772644561 maintained by the first respondent Bank.

2. The petitioner's primary contention is that the first respondent without authority has frozen the petitioner's current account.

3. Learned counsel for the respondent Bank has placed on record the instructions issued by the first respondent whereby it is stated that the Bank account of the petitioner has been frozen stating that the suit in O.S.No.99 of 2022 is filed by Mr.P.Pranesh Rao and Mr.P.Prasanth Rao, who claimed as Heridatory Family Co-Trustees. However, there is no order of restrain passed by the jurisdictional civil Court restraining the petitioner 2/6

from operating the said Bank account nor there is a direction to the Bank to freeze the account of the petitioner.

4. In the absence of any order of restrain, the freezing of the account by the first respondent is arbitrary and discriminatory.

5. Accordingly, the writ petition is allowed. The first respondent is hereby directed to defreeze the petitioner's Trust current account bearing No.772644561 forthwith.

6. There shall be no orders as to costs.
