ORDER : The Court Made the following order :- The petitioner, who is arrayed as A1 in Crime No.48 of 2017 on the file of the respondent police, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 120, 463, 464, 467, 468, 471, 404 and 420 IPC and hence, seeks anticipatory bail.

2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent/State. 3.The learned counsel for the petitioner submitted that the petitioner/A1 along with A2 is alleged to have cheated the defacto complainant by not giving any share in the family properties. He would further submit that the petitioner/A1 is the brother of the defacto complainant. A civil suit is also pending for partition. Due to property dispute, the present false complaint has been lodged by the defacto complainant. The civil case has been given criminal colour. The petitioner is innocent. He has not committed any offence as alleged in the complaint. He has been falsely implicated in this case. He is ready to co-operate with enquiry. https://hcservices.ecourts.gov.in/hcservices/ 4.The learned Additional Public Prosecutor appearing for the respondent / Police submitted that the investigation is pending.

5. Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.I, Madurai and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously. 6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand automatically dismissed.
