Heard both sides.

2. The petitioner wants to conduct the petition mentioned cultural festival. It is an annual temple festival. There is no communal overtone. The petitioner as the 10th day Mandagapaditharar has been conducting the same last year also. The third respondent shall issue No Objection Certificate in favour of the petitioner. The event has to take place in the village limits. Even though the event is to take place from 10.00 pm., to 02.00 am., permission shall be granted. With the No Objection Certificate to be issued by the Deputy Superintendent of Police, the petitioner will approach the first respondent. The first respondent shall 2/4

grant permission as sought for. The first respondent can impose condition regarding the installation of the loudspeaker. The cone-shaped loud speaker shall not be installed. Decibel level will have to be within the permissible limits.

3. The Writ Petition is allowed. No costs.
