ORDER
The present Writ Petition has been filed for the issuance of a Writ of Mandamus, directing the second respondent to conclude the patta cancellation proceedings in respect of the lands in S.Nos. 345/50, 345/55 Kailampatti, Melavalavu village, Melur Taluk, Madurai District, in light of the communication proceedings made in O.Mu.No.7677/2023/A1 dated 30.10.2023 by the second respondent within the time stipulated by this Court.
2. The contention of the petitioner is that the petitioner's property in Survey Nos.345/50 and 345/55, Kailampatti, Melavalavu Village, Melur Taluk, Madurai District, originally belonged to the petitioner's father, namely, Kaalai @ Alagappan Ambalam. The petitioner's father had two wives. Through his first wife, one daughter, namely Chinnammal, was born. The said Chinnammal predeceased the petitioner's father. Thereafter, the petitioner's father died. Through the second wife, he had one male and one female child, namely, Gunasekaran and Arunthathi. The petitioner herein is Arunthathi. After the demise of the first wife, the petitioner's father lived with his second wife and 2/5
subsequently died on 08.10.2006, leaving behind the second wife, the petitioner's brother, and the petitioner. Therefore, all the three are entitled to the property. However, the revenue records shows that patta was issued in favour of one Thangam. The said Thangam has now executed a settlement deed in favour of the fifth respondent.
3. The further contention of the petitioner is that the fifth respondent is not known to the petitioner and does not belong to the petitioner's family. However, the revenue records wrongly reflect patta in favour of the fifth respondent's family. Hence, the petitioner filed a petition seeking cancellation of the patta in the name of the fifth respondent's family as early as in the year 2023. It is seen that a writ petition in W.P.(MD) No.5419 of 2024 was already filed and this Court, by order dated 07.03.2024, directed the official respondents to consider the petitioner's representation and pass appropriate orders. However, no order was passed. Thereafter, the petitioner again approached this Court seeking a direction to conclude the proceedings. The official respondent, after receipt of the complaint, issued notice dated 03.10.2023. Subsequently, the proceedings were not concluded. After filing of the present writ petition, the official respondents issued another notice on 23.02.2026.
4. In view of the above, the official respondents are directed to conclude the 3/5
proceedings within a period of eight weeks from the date of receipt of a copy of this order.
5. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
