PRAYER: Writ Petition filed under Article 226 of the Constitution of India seeking a Writ of mandamus restraining the respondents from carrying out any act of eviction or demolition or interfering with the petitioner's peaceful possession and enjoyment of the property in S.No.280/37 situated at Athankaraipatty Panchayat, Melathirumanickam Village, Elumalai, Firka, Peraiyur Taluk, Madurai District.

(Order of the Court was made by R.SUBRAMANIAN.J) Mr.P.T.Thiraviam, learned Government Advocate appearing for respondent Nos.2 and 4 would submit that the land in Survey No.280/37 is admittedly classified as Grama Natham and occupied by the petitioner by putting up a residential house. He would further submit that the encroachment is with reference to Survey Nos.281 and 282/1. He would also make a statement to the effect that the Block Development Officer has written to the Tahsildar, for effecting survey on 25.02.2023. Depending upon the survey report, further action would be taken. 2/4
