PRAYER: Criminal Original Petition filed under Section 439(1)(b) of Cr.P.C., to modify the condition imposed on the petitioners in Crl.M.P.No.13 of 2017 dated 04.05.2017, by the learned Vacation Sessions Judge, Madurai with a direction to the petitioners to appear before the learned Judicial Magistrate No.VI, Madurai. ORDER

This Criminal Original Petition is filed under Section 439(1)(b) of Cr.P.C., to modify the bail condition imposed by the learned Vacation Sessions Judge, Madurai in Crl.M.P.No.13 of 2017 dated 04.05.2017.

2. Heard Mr.C.M.Arumugam, learned counsel appearing for the petitioners and Mr.R.Ramachandran, learned Additional Public Prosecutor appearing for the respondent.

3. The learned counsel for the petitioners submitted that the petitioners, who were arrested for the offences punishable under Section 392 r/w Sections 379 and 506(ii) IPC in Crime No.453/2017, were granted bail by the learned Vacation Sessions Judge, Madurai, in Crl.M.P.No.13 of 2017 dated 04.05.2017, with condition to report before the respondent Police once in two days between 10.30 a.m. and 11.30 a.m., until further orders. He further submitted that due to intervention of some unknown police personnels, they were not able to comply with the condition imposed regularly.

4. Considering the facts and circumstances of the case, the bail condition imposed on the petitioners by the learned

Vacation Sessions Judge, Madurai, in Crl.M.P.No.13 of 2017, dated 04.05.2017, is modified and the petitioners shall report before the learned Judicial Magistrate No.I, Sivagangai, instead of respondent Police until further orders. This petition is ordered accordingly.
