Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the 3rd and 4th respondents to disburse the terminal benefits without further delay as per the petition dated 09.01.2015 with interest. ORDER
Heard the learned counsel appearing for the petitioner and Mr.K.P.Krishnadoss and Mr.P.Gunasekaran learned counsel who took notice on behalf of the respondents. By consent, the writ petition itself is taken up for final disposal at the admission stage. 2.The petitioner seeks for the issuance of Writ of Mandamus directing the respondents 3 and 4 to disburse his terminal benefits without further delay.
3.It is stated that the petitioner was working as Assistant Executive Engineer and retired on 31.10.2009. It is further stated that the retirement benefits of the petitioner are yet to be settled. It is also stated that the first respondent has already sanctioned pensionary benefits through his proceedings dated 26.09.2014. In spite of the same, the said benefits are not given to the petitioner so far. Therefore, the https://hcservices.ecourts.gov.in/hcservices/
petitioner made a representation on 09.01.2015 seeking for disbursement of terminal benefits. As the said representation has not been considered so far, the present writ petition has been filed for the relief as stated supra.
4.Considering the above stated facts and considering the fact that the petitioner had already retired on 31.10.2009, there should not be delay on the part of the respondents in disbursing the retirement benefits. It appears that the first respondent has also passed an order sanctioning pensionary benefits to the petitioner through his proceedings dated 26.09.2014. If that being the position, the respondents 2 to 4 cannot delay the disbursement any more.
5.Accordingly, the writ petition is disposed of with a direction to the respondents to disburse the terminal benefits of the petitioner within a period of four weeks from the date of receipt of a copy of this order. No costs.
