ORDER : The Court Made the following order :- The petitioner, in Crime No.2 of 2017 on the file of the respondent police, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 406, 417 and 420 of I.P.C., and hence, seeks anticipatory bail.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent/State.

3. The case of the prosecution is that the petitioner's mother and paternal uncle sold their property to the de-facto complainant and received a sum of Rs.33 lakhs and the de-facto complainant is due to pay only a sum of Rs.4 lakhs and at that time, first and second accused sold the property.

4. The learned counsel for the petitioner would submit that suit has been filed before the Sub Court, Trichy and the same was dismissed and now the present complaint has been filed implicating the first and second accused's daughter, who is married in the year 2011 and settled in some other place.

5. Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions. Accordingly, the petitioner is ordered to be https://hcservices.ecourts.gov.in/hcservices/

released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.III, Trichy and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

6. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
