For Respondent : Mr.S.Chandarasekar, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- To enlarge the petitioner on bail in the event of their arrest in connection with a case in CC.no.38 of 2003 on the file of Judicial Magistrate Court No.1, Virudhunagar in Cr.No.94 of 1999 on the file of the respondent police.

ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioners and the learned Additional Public Prosecutor appearing for the respondent. 2.The petitioners apprehending arrest at the hands of the respondent police for the offences punishable under Sections 420, 467 and 468 of I.P.C., in Crime No.94 of 1999, on the file of the respondent police, seek anticipatory bail.

3.The case is of the year 1999. The final report was taken up for trial in the year 2003 in C.C.No.38 of 2003, on the file of the learned Judicial Magistrate No.I, Virudhunagar. These petitioners habitually abscond and deliberately refused to co-operate with the trial and thereby successfully dragging on the case for more than 17 years. Since the Non-bailable Warrant was issued, now they are before this Court.

4.The learned Additional Public Prosecutor appearing for the State submits that atleast 18 Non-Bailable Warrants were issued against these petitioners and later recalled, despite that they are not inclined to co-operate with the prosecution for completion of the trial.

5.I find that the petitioners do not deserve any consideration for granting anticipatory bail. Hence, this petition stands dismissed.
