Writ Petitions filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondents 2 and 3 herein to initiate Revenue Recovery proceedings under Revenue Recovery Act against the 4th respondent herein for recovery of the remaining Award amount of Rs. 1,36,693 /- with 12 percentage interest 1/5

from the date of accident to till the deposit of the said amount in W.C.no. 463/2002 on the file of the Commissioner of Workmen Compensation Court, Madurai dated 30.11.2004 in the light of the communication of the 1st respondent dated 10.07.2024.

O R D E R

This Writ Petition has been filed seeking a direction to the respondents 2 and 3 to initiate revenue recovery proceedings under the Revenue Recovery Act against the fourth respondent for the recovery of the remaining award amount of Rs.1,36,693/- with 12% interest from the date of the accident until the deposit of the said amount in W.C. No. 463 of 2002, on the file of the Commissioner of Workmen Compensation Court, Madurai, dated 30.11.2004, in light of the communication from the first respondent dated 10.07.2024.

2. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself. Having regard to the nature of the order proposed to be passed in this writ petition, notice to the fourth respondent is dispensed with.

3. When the matter was taken up for hearing today, the learned Special Government Pleader, appearing on behalf of the respondents 1 to 3, on instructions, submitted that the award amount of Rs.1,36,193/- has been recovered and deposited by way of Demand Draft No.536674, dated 01.12.2024, before the Joint Commissioner of Workmen Compensation Court, Madurai.

4. Recording the above submission, the Writ Petition stands disposed of, granting liberty to the petitioner to withdraw the amount by filing an appropriate application. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed. 20.03.2025 Index : Yes / No Internet : Yes / No PKN 3/5
