Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned order passed by the first respondent in A.P.No.9/MET(R.R.)/Thamaraipatti Bit-II/2020/B4 dated 25.02.2022 and quash the same as illegal and consequently direct the respondents to fix the compensation to the petitioner's acquired land at par with other lands subdivided from Old Survey No.92, Thamaraipatti Village Bit-2, Madurai East Taluk, Madurai District, i.e., Rs.2,634.41 square meter. ORDER

Learned counsel for the petitioner seeks permission of this Court to withdraw this Writ Petition. However, he seeks liberty of this Court for the petitioner to file an application under Section 34 of the Arbitration and Conciliation Act before the appropriate District Court as against the impugned award passed by the District Collector. The said statement is recorded.

2. Accordingly, this Writ Petition is disposed of by granting liberty to the petitioner to approach the District Court by filing an application under Section 34 of the Arbitration and Conciliation Act as against the impugned award passed by the District Collector. In so far as the limitation issue is concerned, it is for the petitioner to convince the District Court concerned. There shall be no order as to costs.
