Respondents PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of certiorarified mandamus calling for the records relating to the suspension order No.1/2022, dated 21.07.2022, passed by the fourth respondent herein in D.No.5612/21.07.2022, quash the same and direct the fourth respondent herein to set aside the proceedings dated 20.03.2023 and consequently reinstate the petitioner herein from suspension within the time stipulated by this Court.

O R D E R

[Order of the Court was made by R.SUBRAMANIAN, J.] Challenge in this writ petition is to the order of suspension dated 21.07.2022 and the charge memo dated 20.02.2023, issued by the fourth respondent.

2. The petitioner, who is working as Office Assistant in the Court of the Judicial Magistrate, Rajapalayam, was suspended pending enquiry into grave charges on 21.07.2022 and the same was followed with a charge memo requiring the petitioner to explain the charges. The petitioner has rushed to this Court and the entire averments in this writ petition relate to the merits of the charges framed against him and there is no jurisdictional issue involved.

3. The scope of challenge to either the suspension order or the charge memo is very limited. A perusal of the affidavit does not show any permissible or valid ground for such challenge. Hence, this writ petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
