Prayer in CRL MP(MD). 4109/ 2020 :

To condone the absence of the petitioner before the CBCID, Chennai as per order of this Honourable Court dated 29/01/2020 in Crl.O.P.(MD) 17315 of 2019.

Order : These petitions coming on for orders upon perusing the petitions filed in support thereof and upon hearing the arguments of M/S.S.SANKAR, Advocate for the petitioner in both the petitions and of Mr.K.SUYAMBULINGA BHARATHI, Government Advocate(Crl.Side) on behalf of the Respondent in both the petitions, the court made the following order:- This petition has been filed to relax the condition.

2. This Court, by an order dated 29.01.2020 in Crl.OP.(MD) No.17315 of 2019, granted bail to the petitioner on condition that 1/3

the petitioner to stay at Chennai and appear before the Superintendent of Police, CBCID, Central Zone, CBCID Head Quarters, Egmore, Chennai - 600 008 at 10.30 a.m., once in two days.

3. Heard the learned counsel for the petitioner and the learned Government Advocate (criminal side).

4. According to the learned Government Advocate (criminal side) the petitioner has appeared before the Superintendent of Police, CBCID, Central Zone, CBCID Head Quarters, Egmore, Chennai - 600 008, upto 25.03.2020 and thereafter, he is not appeared. Now, because of the petitioner not appeared, the investigation is still pending.

5. Considering the above circumstances, this Court is not inclined to relax the condition imposed on the petitioner.

6. Accordingly, the Criminal Miscellaneous Petitions are dismissed.
