PRAYER: Contempt Petition is filed under Section 11 of the Contempt of Court Act, 1971, to take the above contempt petition on file and issue summons to the respondents herein and deal with them in accordance with law for their willful disobedience of the order dated 28.05.2019 in W.P(MD) No.15521 of 2018. Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a Writ of Certiorarified Mandamus calling for the records relating to the order passed by the 3rd respondent dated 07/05/2018 and order passed by the 2nd respondent in Na.Ka.No.5410 / 2018 / E2 dated Nil.05/2016 signed on 20/06/2018 and Quash the same and consequently direct the 2nd and 3rd respondents to reimburse the medical bills of Rs.3,16,837/- to the Petitioner For Petitioner : Mr.C.Vakeeswaran For Respondents : Mr.M.Sricharan Rangarajan 1 & 2 Additional Advocate General Assisted by Mr.P.Mahendran Additional Government Pleader
ORDER
The learned Additional Advocate General would submit that in consonance with the orders of this court passed in a batch of writ petitions in W.P(MD) No.13429 of 2013 etc., in the case of S.Marimuthu and others Vs The Secretary, Government of Tamil Nadu, Department of Health and Family Welfare and others, the https://hcservices.ecourts.gov.in/hcservices/ 1/2
Cont.P.(MD) No.520 of 2020 reimbursement was made in accordance with the Medical Attendance Rules, along with interest as held in paragraph 80 (iv) and (viii). 2.The learned counsel for the petitioner admitted the receipt of the reimbursement by the petitioner, but disputes the quantum. In my view, the disobedience alleged in the contempt may not be wilful, since the respondents claimed to have disbursed the amount under the Tamil Nadu Medical Attendance Rules in accordance with the orders of this Court. If the petitioner is aggrieved against the quantum of the medical claim reimbursed, it would be open to him to challenge the same in accordance with law.
3.Accordingly, this Contempt Petition stands closed.
