O R D E R

The Writ Petition has been filed challenging the impugned order issued by the respondent on 9.4.2021 in Notification No. 20/2019, dated 21.6.2019 and subsequent addendum No. 20A/2019, dated 6.3.2020 and subsequent addendum No. 20B/2019, dated 16.12.2020.

2.The Petitioner after participating in the selection process under the aforementioned notifications, has challenged the appointments made by the respondent and has also challenged the aforementioned notifications. According to the Petitioner, she is the 122nd rank holder, having secured total mark of 278.75 and therefore, she is eligible to be appointed to the post of Junior Scientific Officer in Forensic Sciences Department under the category of BC(OBCM)(W)(PSTM). However, according to the Petitioner, persons holding lower ranks than that of the Petitioner holding rank No.126, 127 and 128 who had secured lesser marks than that of the Petitioner were appointed to the post of Junior Scientific Officer in Forensic Sciences Department. 2/5

3.A Counter affidavit has been filed by the respondent denying the contentions of the Petitioner, wherein, it has been stated that the last of vacancies allotted for Chemistry Group was filled by the candidate with rank No.106, belonging to SC(W) category. Hence according to the respondent, the Petitioner who stood in rank N0.122 and also belongs to Chemistry Group had no chance to be selected under the subject as well as under communal category. The respondents have categorically stated in the counter that the candidates with rank No.126 and 128 referred to by the Petitioner were selected against the Biology Group. The said contention of the respondents as seen from their counter as referred to supra, has also not been disputed by the learned counsel for the Petitioner.

Admittedly, the Petitioner is challenging the recruitment notifications, pursuant to which, the Petitioner had participated in the selection process only after the Petitioner was unsuccessful in getting appointed to the post of Junior Scientific Officer in Forensic Sciences Department. The Counter filed by the respondent before this Court also makes it clear that under Chemistry Group only the candidate who ranks ahead of the Petitioner was appointed to the post of Junior Scientific Officer, Forensic Sciences Department.

4.For the foregoing reasons, this Court does not find any merit in this Writ Petition. Accordingly, the Writ Petition stands dismissed. No costs. Consequently, connected Miscellaneous Petitions are closed.
