ORDER

This petition has been filed seeking a direction against the respondent herein not to harass the petitioner except under due process of law based on the representation of the petitioner dated 16.06.2020.

2. The learned counsel for the petitioner submits that the respondent police has registered a case against the petitioner in the year 2016 and the same was also closed. However, the respondent police again called the petitioner for enquiry by serving the summon under Section 110 of Cr.P.C. without assigning any reason. He further submits that though the petitioner has not involved in any other offence for the past four years, the respondent police unnecessarily harassing the petitioner by invoking the proceedings under Section 110 Cr.P.C. Hence, the petitioner has sent a detailed representation dated 16.06.2020 to the Commissioner of Police, Trichy and requested to direct the respondent police not to harass the petitioner in any manner. Even though the same was acknowledged, no action has been taken till date. Therefore, the petitioner has come forward with this Criminal Original Petition.

3. Learned Additional Public Prosecutor, on instructions, submits that the respondent police has never called the petitioner for enquiry by invoking the proceedings under Section 110 Cr.P.C. 4.Heard, Mr.B.Jamel Arasu, learned counsel for the petitioner and Mr.K.K.Ramakrishnan, learned Additional Public Prosecutor appearing for the State.
