ORDER : The Court Made the following order :- The earlier bail petition filed by the petitioner in Cr.M.P.No.3014 of 2016, before the Principal Sessions Judge, Thoothukudi, was dismissed for default on 24.10.2016 and it is not a bar for the parties to file a fresh petition. Further, this petition cannot be treated as a second bail petition, as the trial Court has not dismissed the earlier petition on merits. Hence, it is open to the petitioner to file a fresh bail petition before the trial court. In the event of filing any fresh application for bail by the petitioner, it is open to the trial court to take up the matter and consider the same.
