FOR ANTICIPATORY BAIL IN CRIME NO.220/2023 ON THE FILE OF THE RESPONDENT POLICE.

ORDER : The Court Made the following order :- The petitioners/Accused, who apprehend arrest at the hands of the respondent police for the offences punishable under Section 387 of IPC in Crime No.220 of 2023, 1/3

on the file of the respondent police, seek anticipatory bail. 2.The case of the prosecution is that on 13.12.2023 at about 12.15 p.m., the petitioners and others threatened the defacto complainant by showing knife and snatched Rs.2000/- and OPPO phone from him. Hence, the case. 3.Heard. Perused the materials available on record including the First Information Report.

4.It is seen that the petitioners have already filed an application for anticipatory bail before the trial Court in Crl.M.P.No.43 of 2024. However, in respect of the first petitioner, the petition was dismissed on the ground that the property was not recovered and in respect of the second petitioner, the trial Court granted anticipatory bail. However, for non-execution of sureties, the second petitioner filed an extension of time in Crl.M.P.Nos.430 and 425 of 2024 before the trial Court and the time period was further extended till 15.02.2024. However, the second petitioner has failed to comply with the said condition and thereby, the petitioners have filed the present petition before this Court.

5.Considering the facts and circumstances of the case and the fact that till date, the properties have not been recovered and the petitioners had one pervious case of similar in nature, this Court is not inclined to grant anticipatory bail to the petitioners.
