ORDER

[Order of the Court was made by N.ANAND VENKATESH, J.] This petition has been filed seeking suspension of sentence of imprisonment imposed on the petitioner by the learned II Additional District and Sessions Judge, Trichy, in S.C.No.50 of 2024, dated 19.12.2025, to enlarge the petitioners on bail.

2. The case of the prosecution is that P.W.1, A1 and A2 were engaged in the same business and therefore there was a business rivalry. On previous enmity, on 13.07.2018, a complaint was also given by P.W.1 in this regard and both parties were enquired and warned. Therefore, the enmity continued. On the fateful day on 09.01.2019, when P.W.1, the deceased and others were proceeding from Madurai, all the accused persons formed themselves into an unlawful assembly and were armed with deadly weapons and they intercepted the vehicle and P.W.1 and the deceased were attacked with deadly weapons and there was damage to the vehicle. P.W.1 sustained injuries, whereas the deceased succumbed to the injuries. An FIR came to be registered in Crime No.10 of 2019 for the 2/6

offence under Sections 120(B), 148, 341, 326 (2 counts), 427, 149 r/w 302 of IPC. There are totally six accused persons in this case and the petitioner is arrayed as A5.

3. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

The overt act attributed against the petitioner (A5) is that he had attacked P.W.1 and hence the Court below has convicted the petitioner for the offence under Section 326 of IPC and sentenced him to undergo 10 years imprisonment and to pay a fine of Rs.10,000/-, in default to undergo 6 months simple imprisonment.

5. It is brought to the notice of this Court that on a similar footing, A6 has also filed a bail petition in Crl.M.P.(MD) No.1008 of 2026 and this Court, by an order dated 17.02.2026, had granted suspension of sentence. The same yardstick has to be applied for the petitioner also.

6. The learned Additional Public Prosecutor submitted that there is 3/6

an old case of the year 2019, which is pending against the petitioner.

7. In the light of the above discussion, this Court is inclined to grant suspension of sentence, suspending the sentence imposed against the petitioner and accordingly, this petition is allowed on the following conditions:

i. The petitioner is directed to be enlarged on bail on executing a bond for Rs.10,000/- (Rupees Ten thousand only) with two sureties, each for a like sum to the satisfaction of the learned II Additional District and Sessions Judge, Trichy.

ii. The sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Trial Court may obtain a copy of their Aadhar card or Bank passbook to ensure their identity.

iii. The petitioner shall appear and sign before the trial Court at 10.30 a.m., on the first working day of every English calender month, till the disposal of the Criminal Appeal. [N.A.V., J.] & [K.K.R.K, J.] 02.04.2026 NCC : Yes / No Index : Yes / No 4/6
