Petition file under Section 389 (1) of Cr.P.C., to Suspend the sentence and grant bail to the Appellant /Sole Accused against the Conviction judgement dated 24.02.2021 in S.C No. 68/2016 passed by the Sessions Judge, Mahalir Neethimandram Madurai in Crime No. 277/215 on the file of the Respondent, pending disposal of the instant Criminal Appeal.

Prayer in Crl.A(MD).NO.152 of 2021:- Appeal file under Section 374(2) of Cr.P.C., to call for the records relating to the judgment dated 24.02.2021 made in S.C.No.68 of 2016 on the file of the Sesssions Judge, Mahalir Neethimandram, Madurai, and set aside the same as illeal and allow the Appeal. ORDER:- This Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.A.Mu.Sharavanan, Advocate for the Petitioner and of Mrs.M.Aasha, Govt.Advocate(Crl.Side), for the Respondent, this Court made the following order: 1/3

This petition has been filed to relax the condition imposed on the petitioner in Crl.M.P(MD) No.2522 of 2021 in Crl.A(MD)No.152 of 2021, dated 29.06.2021.

2. The learned counsel appearing for the petitioner would submit that the petitioner is complying with the condition regularly.

3. The learned Government Advocate(Crl.Side) appearing for the respondent would submit that the petitioner is regularly complying with the condition.

4. In the light of the above submission, the condition imposed on the petitioner in Crl.M.P(MD) No.2522 of 2021 in Crl.A (MD)No.152 of 2021, dated 29.06.2021 is modified to the effect that the petitioner shall appear before the trial Court once in a month i.e., on the first working day of every English calender month at 10.30 a.m., till the disposal of the Crl.A.(MD) No.152 of 2021.

5. Accordingly, this petition is ordered.
