Petition filed under Article 226 of the Constitution of India for the issuance of Writ of Mandamus, directing to the fourth respondent to file condone delay petition before the 5th respondent in Crime No.13 of 2013 on the file of the Vallathirakottai Police Station, Pudukkottai District and consequently direct the 5th respondent to take cognizance under Section 473 of Criminal Procedure Code. O R D E R

Seeking a direction to the fourth respondent to file an application to condone delay before the learned Judicial Magistrate, Pudukottai, the present petition has been filed.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the State and perused the records.

3. Admittedly, the complaint has been closed on the ground of limitation. Therefore, the petitioner will have to get a copy of the said order. Hence, this Writ Petition is disposed of by giving liberty to the petitioner to file an application seeking a copy of the order passed by the learned Judicial Magistrate, Pudukottai, by whom the complaint was closed on the ground of limitation.

4. Further this court directs the learned Judicial Magistrate, Pudukottai, as and when an application made, appropriate copy of the order passed by the learned Judicial Magistrate, Pudukottai, will have to be given to the petitioner, within a period of two weeks. After receiving the same the petitioner is at liberty to challenge the same in the manner known to law. No costs. Consequently, connected Miscellaneous Petition is closed.
