O R D E R

This Criminal Original Petition has been filed seeking a direction to the second respondent to register the case based on the complaint given by the petitioner herein dated 20.09.2016.

2. The learned Counsel for the petitioner would submit that the petitioner's wife is missing from 15.09.2016 and the petitioner lodged a complaint with the second respondent on the same day, but it was not accepted. Hence, he sent a complaint to the first respondent by registered post on 21.09.2016, however, no action has been taken so far.

3. The learned Government Advocate (Crl.Side), on instructions, would submit that a similar complaint given by the petitioner was registered in Cr.No.126 of 2016 on 08.09.2016 and after recording the statement of the petitioner's wife, the case was closed. Further it is submitted that in the statement, the petitioner's wife categorically stated that she is not willing to reside with her husband/petitioner.

4. Recording the above said statement, this Criminal Original Petition is closed.
