Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a writ of Certiorari, calling for the impugned proceedings D1/R.P.No.6/2007 (L.Ref.) dated 1.12.2008 issued by the 1st Respondent herein and to quash the same as illegal.

ORDER : This writ miscellaneous petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S. NARAYANAKUMAR. K.P, Advocate for the petitioner and of Mr.K.BALASUBRAMANI, Special Government Pleader on behalf of the Respondent Nos.1 to 3, the court made the following order:- This petition is filed to condone the delay of 834 days in filing the restoration petition to restore the writ petition in W.P.(MD)No.2895 of 2009, which was dismissed for non-prosecution on 22.11.2018.

2. Heard both sides.

3. This Court is satisfied with the reasons stated in the supporting affidavit.

4. However, considering the period of delay, this petition is allowed on condition that the petitioner shall pay a sum of Rs.5,000/- (Rupees five thousand only) to the credit of Current Account No. 7567821433, (IFSC Code: IDIBI000H040), 2/4
