PRAYER : Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to direct the 1st respondent to withdraw the investigation of the FIR in Crime No.58 of 2023 from the file of 2nd Respondent to transfer the same to the 3rd Respondent or any other 1/4

ORDER

This Criminal Original Petition has been filed, invoking Section 482 Cr.P.C., seeking direction to direct the 1st respondent to withdraw the investigation of the FIR in Crime No.58 of 2023 from the file of 2nd Respondent to transfer the same to the 3rd Respondent or any other competent and suitable investigation officer as this Court may deem fit and proper in these above facts and circumstances of the case.

2. Now the grievance of the petitioner is that the respondents herein propose to delete the real accused namely Sridhar from the case.

3. On perusal of CD file shows that so far no summon has been issued to the above said Sridhar. The second respondent is present before this Court and stated that yesterday only the summon has been issued to 2/4

the said Sridhar.

3. It is the premature stage. The petitioner can wait till the completion of the investigation. If the petitioner is aggrieved with the outcome of the investigation, he can approach the Court for appropriate remedy.

4. With the above said liberty, this Criminal Original Petition is disposed of.
